1. About RunTime Recruitment
RunTime Recruitment is a specialist engineering recruitment agency placing embedded systems, firmware, FPGA, controls, automation, BESS, mining automation, mechanical, and edge AI engineers across Australia, New Zealand, and the USA.
These terms govern the relationship between RunTime Recruitment and our clients (companies seeking to hire engineers) and candidates (engineers seeking roles). By engaging our services, you agree to these terms.
2. Client Terms
2.1 Engagement
Engagement of RunTime Recruitment's services constitutes acceptance of these terms. A written brief or job specification provided to us confirms our engagement on a role.
2.2 Fees
Our placement fee is calculated as a percentage of the placed candidate's total first-year remuneration package (base salary plus superannuation or equivalent). The applicable percentage will be agreed in writing prior to commencing a search. Fees become payable upon the candidate's acceptance of a written offer of employment.
2.3 Payment Terms
Invoices are payable within 30 days of issue. Late payments may attract interest at the rate of 2% per month on the outstanding balance.
2.4 Replacement Guarantee
We offer a 90-day replacement guarantee. If a placed candidate leaves or is terminated within 90 days of their start date for reasons relating to suitability, we will conduct a replacement search at no additional fee. The guarantee does not apply where the candidate's departure results from redundancy, role change, or employer conduct.
2.5 Candidate Introduction
A fee is payable if a candidate introduced by RunTime Recruitment is engaged by the client within 12 months of introduction, whether directly or through another party. Introduction is defined as the provision of a candidate's CV or details to the client.
2.6 Confidentiality
Both parties agree to keep confidential any information shared during the recruitment process, including candidate details, remuneration data, and commercial terms.
3. Candidate Terms
3.1 Representation
By submitting your details to RunTime Recruitment, you authorise us to represent you to prospective employers. We will seek your explicit consent before presenting your details to any specific employer.
3.2 Accuracy of Information
You warrant that all information you provide to us, including your CV, qualifications, employment history, and right to work status, is accurate and complete. Misrepresentation may result in termination of our representation and may have legal consequences.
3.3 Exclusivity
We do not require exclusivity. You are free to engage other recruitment agencies simultaneously. However, we ask that you inform us if you are already in an active process with a prospective employer before we present you to that employer.
3.4 No Fees to Candidates
RunTime Recruitment does not charge fees to candidates. Our fees are paid entirely by the hiring client.
3.5 Data and Privacy
Your personal information is handled in accordance with our Privacy Policy. We retain candidate data for up to three years. You may request deletion of your data at any time.
4. International Placements
Where a placement involves international sponsorship or visa requirements, it is the client's responsibility to ensure compliance with all applicable immigration laws. RunTime Recruitment can advise on market availability and candidate willingness to relocate but does not provide immigration legal advice. Clients engaging international candidates should obtain independent immigration legal advice.
5. Limitation of Liability
RunTime Recruitment's liability in connection with any placement or recruitment service is limited to the fee paid for that placement. We are not liable for any indirect, consequential, or special loss arising from a candidate's performance, termination, or departure.
6. Governing Law
These terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Australia.
7. Changes to These Terms
We may update these terms from time to time. The date at the top of this page reflects the most recent revision. Continued engagement of our services constitutes acceptance of the updated terms.
